State Public Employee Relations Boards

State Public Employee Relations Boards (PERB) are impartial, quasi-judicial, independent agencies that resolve labor-management disputes between agencies of the state government (usually including cities, counties and towns) and labor organizations representing agency employees.

Although individual state PERB's operate under different statutes, they typically are responsible for:

  • determining what constitutes a bargaining unit;
  • conducting secret ballot elections to certify or decertify labor organizations as exclusive bargaining representatives;
  • adjudicating unfair labor practice (ULP) complaints;
  • considering appeals of grievance arbitration awards;
  • determining whether a particular subject or proposal is within the scope of bargaining
